Dans ce contexte, <strong>l&#8217;employeur peut-il prononcer un licenciement ?<\/strong> Et qu\u2019en est-il depuis l\u2019introduction de la <strong>pr\u00e9somption de d\u00e9mission en 2023<\/strong> ?&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>L\u2019abandon de poste peut-il justifier un licenciement ?<\/strong><\/h2>\n\n\n\n<p>Oui, un salari\u00e9 qui ne se pr\u00e9sente plus \u00e0 son poste sans autorisation de son employeur <strong>s\u2019expose \u00e0 un licenciement pour faute grave<\/strong>. Ce type de licenciement repose sur la rupture unilat\u00e9rale du contrat de travail par le salari\u00e9, sans pr\u00e9avis ni justificatif valable. Toutefois, l\u2019abandon de poste ne suffit pas en soi\u202f: il doit \u00eatre <strong>constat\u00e9<\/strong>, <strong>formellement notifi\u00e9<\/strong>, et <strong>laisser place \u00e0 un droit de r\u00e9ponse<\/strong>.<\/p>\n\n\n\n<p>Concr\u00e8tement, l\u2019employeur doit envoyer une <strong>mise en demeure de reprendre le travail ou de s\u2019expliquer<\/strong>, souvent par courrier recommand\u00e9. Si le salari\u00e9 ne r\u00e9agit pas ou confirme implicitement qu\u2019il n\u2019a pas l\u2019intention de revenir, l\u2019entreprise peut alors engager une proc\u00e9dure de licenciement disciplinaire.<\/p>\n\n\n\n<p><strong>Une proc\u00e9dure profond\u00e9ment modifi\u00e9e par la r\u00e9forme de 2023<\/strong><\/p>\n\n\n\n<p>Depuis un d\u00e9cret du 17 avril 2023, la l\u00e9gislation encadre plus strictement l\u2019abandon de poste en introduisant une <strong>pr\u00e9somption de d\u00e9mission<\/strong>. D\u00e9sormais, si un salari\u00e9 abandonne son poste volontairement, l\u2019employeur <strong>n\u2019est plus contraint de recourir au licenciement pour faute grave<\/strong> : il peut <strong>consid\u00e9rer le contrat comme rompu du fait du salari\u00e9<\/strong>.<\/p>\n\n\n\n<p>Ce changement a un impact direct :<br>Le salari\u00e9 <strong>perd son droit aux allocations ch\u00f4mage<\/strong>, sauf s\u2019il r\u00e9ussit \u00e0 contester la proc\u00e9dure devant le conseil de prud\u2019hommes. L\u2019objectif de la r\u00e9forme est clair : <strong>dissuader les abandons de poste strat\u00e9giques<\/strong>, qui permettaient auparavant de provoquer un licenciement pour ensuite toucher le ch\u00f4mage.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Le salari\u00e9 peut-il encore \u00eatre licenci\u00e9 dans certains cas ?<\/strong><\/h2>\n\n\n\n<p>Oui. Si l\u2019employeur choisit de ne pas recourir \u00e0 la pr\u00e9somption de d\u00e9mission, il peut toujours <strong>initier une proc\u00e9dure de licenciement pour faute grave<\/strong>, \u00e0 condition de respecter les r\u00e8gles classiques\u202f: convocation \u00e0 un entretien pr\u00e9alable, d\u00e9lais l\u00e9gaux, notification \u00e9crite de la d\u00e9cision. Cette option reste utile notamment si l\u2019abandon de poste <strong>s\u2019inscrit dans un comportement plus globalement probl\u00e9matique<\/strong> (manquements r\u00e9p\u00e9t\u00e9s, refus d&rsquo;ob\u00e9ir, conflits, etc.).<\/p>\n\n\n\n<p>Mais dans la majorit\u00e9 des cas aujourd\u2019hui, <strong>la pr\u00e9somption de d\u00e9mission pr\u00e9vaut<\/strong>, car elle permet une rupture plus rapide et s\u00e9curis\u00e9e pour l\u2019employeur.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>La contestation reste possible c\u00f4t\u00e9 salari\u00e9<\/strong><\/h2>\n\n\n\n<p>Un salari\u00e9 accus\u00e9 d\u2019abandon de poste peut contester la pr\u00e9somption de d\u00e9mission dans un <strong>d\u00e9lai de 15 jours<\/strong> \u00e0 compter de la notification. Mais la diff\u00e9rence majeure tient aux <strong>droits sociaux<\/strong>\u202f:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>En cas de <strong>licenciement pour faute grave<\/strong>, le salari\u00e9 <strong>peut ouvrir droit \u00e0 l\u2019assurance ch\u00f4mage<\/strong> (sauf faute lourde).<\/li>\n\n\n\n<li>En cas de <strong>pr\u00e9somption de d\u00e9mission<\/strong>, <strong>aucun droit au ch\u00f4mage n\u2019est ouvert<\/strong>, sauf contestation r\u00e9ussie.<\/li>\n<\/ul>\n\n\n\n<p>Pour les salari\u00e9s, l\u2019impact peut donc \u00eatre consid\u00e9rable.
