Pourtant, dans certains cas bien pr\u00e9cis, il est l\u00e9galement possible de quitter son poste sans attendre la fin de ce d\u00e9lai. Ces situations, qui d\u00e9rogent \u00e0 la r\u00e8gle g\u00e9n\u00e9rale, r\u00e9pondent \u00e0 des crit\u00e8res stricts et doivent \u00eatre soigneusement identifi\u00e9es pour \u00e9viter tout conflit juridique ou financier.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>D\u00e9part imm\u00e9diat possible pendant la p\u00e9riode d\u2019essai<\/strong><\/h2>\n\n\n\n<p>La p\u00e9riode d\u2019essai est une phase transitoire au cours de laquelle employeur et salari\u00e9 \u00e9valuent la compatibilit\u00e9 de leur collaboration. Pendant cette p\u00e9riode, la rupture du contrat, qu\u2019elle soit initi\u00e9e par l\u2019une ou l\u2019autre des parties, est plus souple et s\u2019accompagne g\u00e9n\u00e9ralement d\u2019un d\u00e9lai de pr\u00e9venance tr\u00e8s court. Selon la dur\u00e9e d\u2019anciennet\u00e9 dans l\u2019entreprise, ce d\u00e9lai peut varier de 24 \u00e0 48 heures, voire \u00eatre supprim\u00e9 si les deux parties sont d\u2019accord. Ainsi, un salari\u00e9 en p\u00e9riode d\u2019essai peut souvent d\u00e9missionner sans pr\u00e9avis, ou avec un d\u00e9lai extr\u00eamement r\u00e9duit, ce qui lui permet de changer de poste rapidement sans engagement prolong\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>D\u00e9mission sans pr\u00e9avis en cas de manquements graves de l\u2019employeur<\/strong><\/h2>\n\n\n\n<p>L\u2019une des exceptions majeures concerne les situations o\u00f9 l\u2019employeur ne respecte pas ses obligations contractuelles ou l\u00e9gales.
