Mais que se passe-t-il lorsque la p\u00e9riode d\u2019essai arrive \u00e0 son terme et n\u2019est pas renouvel\u00e9e\u202f? Quels sont les droits du salari\u00e9 et les obligations l\u00e9gales de l\u2019employeur\u202f? Voici tout ce qu\u2019il faut savoir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Comprendre la p\u00e9riode d\u2019essai et ses conditions l\u00e9gales<\/strong><\/h2>\n\n\n\n<p>La p\u00e9riode d\u2019essai n\u2019est pas obligatoire, mais elle est tr\u00e8s fr\u00e9quente dans les <strong>CDI et CDD<\/strong>. Elle permet :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00e0 l\u2019employeur de v\u00e9rifier les comp\u00e9tences et l\u2019adaptabilit\u00e9 du salari\u00e9,<\/li>\n\n\n\n<li>au salari\u00e9 de confirmer que le poste correspond \u00e0 ses attentes.<\/li>\n<\/ul>\n\n\n\n<p>Selon le <strong>Code du travail<\/strong>, la dur\u00e9e maximale varie :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>CDI<\/strong> : 2 mois pour les ouvriers et employ\u00e9s, 3 mois pour les agents de ma\u00eetrise et techniciens, 4 mois pour les cadres.<\/li>\n\n\n\n<li><strong>CDD<\/strong> : elle est proportionnelle \u00e0 la dur\u00e9e du contrat, sans d\u00e9passer la moiti\u00e9 de sa dur\u00e9e totale.<\/li>\n<\/ul>\n\n\n\n<p>Le renouvellement est possible uniquement <strong>si le contrat le pr\u00e9voit explicitement<\/strong> et <strong>avec l\u2019accord \u00e9crit des deux parties<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>La fin de la p\u00e9riode d\u2019essai : que se passe-t-il si elle n\u2019est pas renouvel\u00e9e ?<\/strong><\/h2>\n\n\n\n<p>Lorsque la p\u00e9riode d\u2019essai <strong>n\u2019est pas renouvel\u00e9e<\/strong> :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>le contrat continue normalement en CDI ou s\u2019arr\u00eate \u00e0 la fin du CDD selon sa dur\u00e9e initiale,<\/li>\n\n\n\n<li>l\u2019employeur n\u2019a <strong>aucune obligation de justification<\/strong>, sauf clause particuli\u00e8re ou dispositions conventionnelles.<\/li>\n<\/ul>\n\n\n\n<p>Pour le salari\u00e9, cela signifie qu\u2019il <strong>n\u2019est pas licenci\u00e9<\/strong>, mais simplement que l\u2019essai n\u2019a pas \u00e9t\u00e9 transform\u00e9 en collaboration d\u00e9finitive.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les obligations de l\u2019employeur \u00e0 la fin de la p\u00e9riode d\u2019essai<\/strong><\/h2>\n\n\n\n<p>M\u00eame si le renouvellement n\u2019est pas pr\u00e9vu, l\u2019employeur doit respecter certaines obligations :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Informer le salari\u00e9<\/strong> suffisamment t\u00f4t pour lui permettre d\u2019anticiper la suite de sa carri\u00e8re. La loi ne fixe pas de d\u00e9lai pr\u00e9cis, mais une <strong>pr\u00e9venance raisonnable<\/strong> est recommand\u00e9e (souvent quelques jours \u00e0 deux semaines).<\/li>\n\n\n\n<li><strong>Remettre les documents habituels<\/strong> : bulletin de salaire, certificat de travail, attestation P\u00f4le emploi pour les CDD.<\/li>\n\n\n\n<li>Respecter <strong>l\u2019\u00e9galit\u00e9 de traitement<\/strong> : aucun salari\u00e9 ne peut \u00eatre \u00e9cart\u00e9 pour des motifs discriminatoires (\u00e2ge, sexe, origine, etc.).<\/li>\n<\/ul>\n\n\n\n<p>\u26a0\ufe0f Exemple : si un salari\u00e9 a effectu\u00e9 un CDI avec une p\u00e9riode d\u2019essai de 3 mois et que l\u2019employeur d\u00e9cide de ne pas la renouveler, il doit lui fournir un <strong>certificat de travail<\/strong> et un <strong>relev\u00e9 de r\u00e9mun\u00e9ration<\/strong>, m\u00eame si la collaboration a \u00e9t\u00e9 courte.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les droits du salari\u00e9 lorsque la p\u00e9riode d\u2019essai n\u2019est pas renouvel\u00e9e<\/strong><\/h2>\n\n\n\n<p>Lorsque la p\u00e9riode d\u2019essai n\u2019est pas prolong\u00e9e, le salari\u00e9 conserve certains droits :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>R\u00e9mun\u00e9ration compl\u00e8te<\/strong> pour toute la p\u00e9riode travaill\u00e9e,<\/li>\n\n\n\n<li><strong>Indemnit\u00e9 de cong\u00e9s pay\u00e9s<\/strong> pour les jours acquis,<\/li>\n\n\n\n<li><strong>Certificat de travail et attestation P\u00f4le emploi<\/strong>, indispensable pour les d\u00e9marches futures.<\/li>\n<\/ul>\n\n\n\n<p>Le salari\u00e9 peut \u00e9galement demander <strong>des explications \u00e0 l\u2019employeur<\/strong>, m\u00eame si celui-ci n\u2019est pas oblig\u00e9 de justifier sa d\u00e9cision.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Le r\u00f4le des conventions collectives et accords d\u2019entreprise<\/strong><\/h2>\n\n\n\n<p>Certaines conventions collectives imposent des <strong>d\u00e9lai de pr\u00e9venance obligatoires<\/strong>, ou pr\u00e9voient une <strong>r\u00e9tribution sp\u00e9cifique en cas de fin de p\u00e9riode d\u2019essai<\/strong>.
