Contrairement \u00e0 l\u2019entretien professionnel ou \u00e0 l\u2019entretien pr\u00e9alable \u00e0 une sanction, celui-ci n\u2019est pas encadr\u00e9 par le Code du travail. Cela soul\u00e8ve une question importante : un salari\u00e9 a-t-il l\u2019obligation d\u2019y assister ou peut-il refuser ?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Qu\u2019est-ce qu\u2019un entretien informel et en quoi il diff\u00e8re d\u2019un entretien officiel&nbsp;?<\/strong><\/h2>\n\n\n\n<p>Un <strong>entretien informel<\/strong> est une rencontre propos\u00e9e par l\u2019employeur, g\u00e9n\u00e9ralement pour \u00e9changer de mani\u00e8re plus souple que dans un cadre officiel. Il peut servir \u00e0 :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>discuter de la charge de travail,<\/li>\n\n\n\n<li>\u00e9voquer des difficult\u00e9s relationnelles,<\/li>\n\n\n\n<li>recueillir un ressenti,<\/li>\n\n\n\n<li>pr\u00e9parer une r\u00e9organisation interne.<\/li>\n<\/ul>\n\n\n\n<p>La grande diff\u00e9rence avec un <strong>entretien disciplinaire<\/strong> ou un <strong>entretien professionnel<\/strong> est qu\u2019il ne repose sur aucun texte l\u00e9gal pr\u00e9cis. Il n\u2019existe donc <strong>aucune obligation pour le salari\u00e9 d\u2019y participer<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Le salari\u00e9 est-il oblig\u00e9 d\u2019accepter un entretien informel propos\u00e9 par l\u2019employeur&nbsp;?<\/strong><\/h2>\n\n\n\n<p>La r\u00e9ponse est non : le salari\u00e9 <strong>n\u2019a aucune obligation l\u00e9gale<\/strong> de se pr\u00e9senter \u00e0 un entretien informel.<br>Tant qu\u2019il ne s\u2019agit pas d\u2019un entretien pr\u00e9vu par la loi (comme l\u2019entretien annuel, l\u2019entretien professionnel ou l\u2019entretien pr\u00e9alable \u00e0 une sanction), l\u2019employeur ne peut pas contraindre le salari\u00e9.<\/p>\n\n\n\n<p>\u2696\ufe0f Juridiquement, un refus n\u2019est donc <strong>pas constitutif d\u2019une faute<\/strong>. Aucune sanction disciplinaire ne peut \u00eatre prononc\u00e9e uniquement pour ce motif.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Quels risques pour un salari\u00e9 qui refuse un entretien informel&nbsp;?<\/strong><\/h2>\n\n\n\n<p>M\u00eame si le salari\u00e9 peut refuser, cela peut avoir des <strong>cons\u00e9quences relationnelles<\/strong>. L\u2019employeur peut interpr\u00e9ter ce refus comme un manque de coop\u00e9ration ou de dialogue.
