Mais entre la th\u00e9orie et la pratique, la question du <strong>d\u00e9lai de carence<\/strong> pr\u00eate souvent \u00e0 confusion.<br>Trois jours ? Sept jours ? Z\u00e9ro jour dans certains cas ? Tout d\u00e9pend du statut, du r\u00e9gime et des \u00e9ventuelles conventions collectives. Comprendre ces subtilit\u00e9s est essentiel pour \u00e9viter les mauvaises surprises sur sa fiche de paie.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>D\u00e9finition claire : qu\u2019est-ce que le d\u00e9lai de carence maladie ?<\/strong><\/h2>\n\n\n\n<p>Le <strong>d\u00e9lai de carence<\/strong> correspond \u00e0 la p\u00e9riode non indemnis\u00e9e au d\u00e9but d\u2019un arr\u00eat maladie. Pendant ce laps de temps, le salari\u00e9 ne touche <strong>ni salaire<\/strong>, ni indemnit\u00e9s journali\u00e8res (sauf dispositions plus favorables pr\u00e9vues par l\u2019employeur).<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pour un <strong>salari\u00e9 du priv\u00e9<\/strong>, la S\u00e9curit\u00e9 sociale applique un d\u00e9lai de <strong>3 jours<\/strong>.<\/li>\n\n\n\n<li>Dans la <strong>fonction publique<\/strong>, ce d\u00e9lai a longtemps fait d\u00e9bat : supprim\u00e9 en 2014, r\u00e9introduit en 2018, il est actuellement fix\u00e9 \u00e0 <strong>1 jour<\/strong>.<\/li>\n\n\n\n<li>Pour les <strong>travailleurs ind\u00e9pendants<\/strong>, depuis 2021, le d\u00e9lai est de <strong>3 jours<\/strong> \u00e9galement.<\/li>\n<\/ul>\n\n\n\n<p>\ud83d\udc49 Concr\u00e8tement : un salari\u00e9 du priv\u00e9 en arr\u00eat maladie du lundi au vendredi sera indemnis\u00e9 par la S\u00e9curit\u00e9 sociale \u00e0 partir du jeudi.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Le cas standard : 3 jours de carence pour les salari\u00e9s du priv\u00e9<\/strong><\/h2>\n\n\n\n<p>Selon le <strong>Code de la S\u00e9curit\u00e9 sociale<\/strong>, les arr\u00eats maladie des salari\u00e9s du secteur priv\u00e9 sont soumis \u00e0 un d\u00e9lai de carence de <strong>3 jours calendaires<\/strong>.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Jour 1 \u00e0 3 : aucune indemnit\u00e9 de la S\u00e9curit\u00e9 sociale.<\/li>\n\n\n\n<li>\u00c0 partir du 4\u1d49 jour : versement des indemnit\u00e9s journali\u00e8res (50 % du salaire brut de r\u00e9f\u00e9rence).<\/li>\n<\/ul>\n\n\n\n<p>\u26a0\ufe0f Attention : si l\u2019arr\u00eat se prolonge, les 3 jours de carence ne sont pas appliqu\u00e9s de nouveau. Mais en cas de <strong>nouvel arr\u00eat distinct<\/strong>, un autre d\u00e9lai s\u2019applique, sauf s\u2019il s\u2019agit d\u2019une rechute de la m\u00eame maladie dans un d\u00e9lai de 10 jours.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les exceptions qui changent tout : quand il n\u2019y a pas de carence<\/strong><\/h2>\n\n\n\n<p>Certains cas permettent de supprimer le d\u00e9lai de carence. C\u2019est notamment le cas :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>En cas d\u2019<strong>accident du travail<\/strong> ou de <strong>maladie professionnelle<\/strong> \u2192 indemnisation imm\u00e9diate d\u00e8s le 1er jour.<\/li>\n\n\n\n<li>En cas d\u2019<strong>hospitalisation<\/strong> \u2192 pas de carence si l\u2019arr\u00eat est li\u00e9 \u00e0 l\u2019hospitalisation.<\/li>\n\n\n\n<li>Lors d\u2019une <strong>rechute<\/strong> d\u2019une pathologie d\u00e9j\u00e0 reconnue dans les 10 jours suivant la reprise \u2192 pas de nouveau d\u00e9lai appliqu\u00e9.<\/li>\n\n\n\n<li>Quand l\u2019<strong>employeur maintient le salaire<\/strong> d\u00e8s le 1er jour gr\u00e2ce \u00e0 la convention collective ou un accord d\u2019entreprise.<\/li>\n<\/ul>\n\n\n\n<p>\ud83d\udca1 Exemple : dans le secteur bancaire ou de l\u2019\u00e9nergie, certaines conventions suppriment totalement le d\u00e9lai de carence en cas d\u2019arr\u00eat maladie.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Fonction publique : un r\u00e9gime particulier avec 1 jour de carence<\/strong><\/h2>\n\n\n\n<p>Les agents publics ne sont pas soumis aux m\u00eames r\u00e8gles que les salari\u00e9s du priv\u00e9. Depuis la r\u00e9forme de 2018, le <strong>d\u00e9lai de carence est fix\u00e9 \u00e0 1 jour<\/strong> seulement pour un arr\u00eat maladie ordinaire.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Jour 1 : non indemnis\u00e9.<\/li>\n\n\n\n<li>Jour 2 et suivants : traitement maintenu par l\u2019administration (avec conditions).<\/li>\n<\/ul>\n\n\n\n<p>\ud83d\udc49 Ce r\u00e9gime vise \u00e0 limiter l\u2019absent\u00e9isme de courte dur\u00e9e, tout en restant plus favorable que le priv\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les travailleurs ind\u00e9pendants : 3 jours, mais avec des nuances<\/strong><\/h2>\n\n\n\n<p>Depuis la r\u00e9forme de 2021, les <strong>travailleurs ind\u00e9pendants<\/strong> (artisans, commer\u00e7ants, professions lib\u00e9rales affili\u00e9es au r\u00e9gime g\u00e9n\u00e9ral) b\u00e9n\u00e9ficient d\u2019indemnit\u00e9s journali\u00e8res en cas d\u2019arr\u00eat maladie, mais avec un d\u00e9lai de carence de <strong>3 jours<\/strong>.<\/p>\n\n\n\n<p>Exemple : un artisan en arr\u00eat de 7 jours ne sera indemnis\u00e9 qu\u2019\u00e0 partir du 4\u1d49 jour.<br>Toutefois, certaines caisses compl\u00e9mentaires (comme la CIPAV pour les professions lib\u00e9rales) pr\u00e9voient des dispositifs plus favorables.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Quand le d\u00e9lai grimpe \u00e0 7 jours : l\u2019impact des compl\u00e9mentaires sant\u00e9<\/strong><\/h2>\n\n\n\n<p>Le fameux d\u00e9lai de <strong>7 jours<\/strong> n\u2019est pas impos\u00e9 par la loi, mais peut appara\u00eetre dans certains contrats de <strong>pr\u00e9voyance<\/strong> ou d\u2019<strong>assurance compl\u00e9mentaire sant\u00e9<\/strong>.<\/p>\n\n\n\n<p>\ud83d\udc49 Exemple : une mutuelle d\u2019entreprise peut pr\u00e9voir un d\u00e9lai de franchise de 7 jours avant de compl\u00e9ter les indemnit\u00e9s journali\u00e8res de la S\u00e9curit\u00e9 sociale.<br>Cela signifie que m\u00eame si la S\u00e9cu commence \u00e0 payer apr\u00e8s 3 jours, le salari\u00e9 ne percevra pas le compl\u00e9ment de salaire avant le 8\u1d49 jour.<\/p>\n\n\n\n<p>C\u2019est cette r\u00e8gle contractuelle qui explique la confusion entre les 3 et les 7 jours.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Le r\u00f4le des conventions collectives et accords d\u2019entreprise<\/strong><\/h2>\n\n\n\n<p>Le d\u00e9lai de carence l\u00e9gal (3 jours) peut \u00eatre compens\u00e9 par le maintien de salaire de l\u2019employeur, lorsqu\u2019une <strong>convention collective<\/strong> le pr\u00e9voit.<\/p>\n\n\n\n<p>Exemples :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Dans la <strong>m\u00e9tallurgie<\/strong>, certains accords pr\u00e9voient un maintien d\u00e8s le 1er jour.<\/li>\n\n\n\n<li>Dans la <strong>restauration<\/strong>, le maintien intervient souvent apr\u00e8s 7 jours, ce qui prolonge le manque \u00e0 gagner pour le salari\u00e9.<\/li>\n<\/ul>\n\n\n\n<p>\ud83d\udcca Selon une \u00e9tude Dares, environ <strong>60 % des salari\u00e9s<\/strong> b\u00e9n\u00e9ficient d\u2019une prise en charge plus favorable vraiment&nbsp;?<\/strong><\/h2>\n\n\n\n<p>Un d\u00e9lai de carence, m\u00eame court, peut repr\u00e9senter une perte significative.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pour un salari\u00e9 r\u00e9mun\u00e9r\u00e9 <strong>2 000 \u20ac brut par mois<\/strong>, 3 jours non indemnis\u00e9s \u00e9quivalent \u00e0 environ <strong>200 \u20ac de manque \u00e0 gagner<\/strong>.<\/li>\n\n\n\n<li>Pour les ind\u00e9pendants, la perte peut \u00eatre encore plus lourde, surtout sans compl\u00e9mentaire pr\u00e9voyance.<\/li>\n<\/ul>\n\n\n\n<p>C\u2019est pourquoi de nombreux salari\u00e9s choisissent une <strong>mutuelle renforc\u00e9e<\/strong> ou une <strong>assurance pr\u00e9voyance individuelle<\/strong> pour r\u00e9duire cet impact.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Que dit la loi en r\u00e9sum\u00e9 : 3 jours de base, mais des am\u00e9nagements possibles<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Priv\u00e9<\/strong> : 3 jours de carence, sauf exceptions (accident du travail, hospitalisation\u2026).<\/li>\n\n\n\n<li><strong>Public<\/strong> : 1 jour de
