{"id":13834,"date":"2025-10-14T12:50:55","date_gmt":"2025-10-14T12:50:55","guid":{"rendered":"https:\/\/www.e-works.fr\/blog\/?p=13834"},"modified":"2025-10-14T12:50:57","modified_gmt":"2025-10-14T12:50:57","slug":"indemnite-de-licenciement-pour-motif-personnel-quel-montant","status":"publish","type":"post","link":"https:\/\/www.e-works.fr\/blog\/indemnite-de-licenciement-pour-motif-personnel-quel-montant\/","title":{"rendered":"Indemnit\u00e9 de licenciement pour motif personnel : quel montant ?"},"content":{"rendered":"\n<p>Lorsqu\u2019un salari\u00e9 est licenci\u00e9 pour motif personnel, il peut b\u00e9n\u00e9ficier d\u2019une <strong>indemnit\u00e9 de licenciement<\/strong>.<br>Cette somme vise \u00e0 <strong>compenser la perte d\u2019emploi<\/strong>, soutenir la transition professionnelle et reconna\u00eetre l\u2019anciennet\u00e9 du salari\u00e9.<\/p>\n\n\n\n<p>Mais le montant exact d\u00e9pend de plusieurs param\u00e8tres : <strong>anciennet\u00e9, salaire, type de contrat, et nature du licenciement<\/strong>.<br>Avant de signer quoi que ce soit, il est essentiel de <strong>comprendre comment se calcule cette indemnit\u00e9<\/strong>, quelles r\u00e8gles s\u2019appliquent l\u00e9galement, et quelles possibilit\u00e9s existent pour obtenir plus.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les r\u00e8gles l\u00e9gales de base pour l\u2019indemnit\u00e9 de licenciement<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Qui a droit \u00e0 une indemnit\u00e9 ?<\/h3>\n\n\n\n<p>Tout salari\u00e9 en <strong>CDI<\/strong>, ayant <strong>au moins 8 mois d\u2019anciennet\u00e9 continue<\/strong>, a droit \u00e0 une indemnit\u00e9 en cas de licenciement pour motif personnel, sauf si le licenciement est <strong>pour faute grave ou lourde<\/strong>.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La <strong>faute grave<\/strong> : exclusion de l\u2019indemnit\u00e9, mais le salari\u00e9 re\u00e7oit ses droits de cong\u00e9s pay\u00e9s.<\/li>\n\n\n\n<li>La <strong>faute lourde<\/strong> : \u00e9galement pas d\u2019indemnit\u00e9, car elle implique un pr\u00e9judice pour l\u2019employeur.<\/li>\n<\/ul>\n\n\n\n<p>\ud83d\udca1 \u00c0 noter : Les salari\u00e9s en <strong>CDD ou int\u00e9rim<\/strong> n\u2019ont pas droit \u00e0 cette indemnit\u00e9, sauf clauses particuli\u00e8res pr\u00e9vues dans le contrat.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Comment se calcule le montant l\u00e9gal ?<\/h3>\n\n\n\n<p>Le montant minimal est fix\u00e9 par le <strong>Code du travail<\/strong>.<br>Depuis 2023, la formule l\u00e9gale est :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>1\/4 de mois de salaire par ann\u00e9e d\u2019anciennet\u00e9<\/strong> pour les <strong>10 premi\u00e8res ann\u00e9es<\/strong>.<\/li>\n\n\n\n<li><strong>1\/3 de mois de salaire par ann\u00e9e au-del\u00e0 de 10 ans<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p><strong>Salaire de r\u00e9f\u00e9rence<\/strong> : il correspond g\u00e9n\u00e9ralement \u00e0 la <strong>moyenne des 12 derniers mois de salaire brut<\/strong>, ou des <strong>3 derniers mois si cela est plus avantageux<\/strong> (en incluant primes et avantages fixes).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Exemples de calcul de l\u2019indemnit\u00e9&nbsp;<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Cas 1 : salari\u00e9 avec 5 ans d\u2019anciennet\u00e9<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Salaire mensuel brut : 2 000 \u20ac<\/li>\n\n\n\n<li>Anciennet\u00e9 : 5 ans<\/li>\n\n\n\n<li>Calcul : 2 000 \u00d7 1\/4 \u00d7 5 = 2 500 \u20ac<\/li>\n<\/ul>\n\n\n\n<p>Le salari\u00e9 toucherait donc <strong>2 500 \u20ac<\/strong> d\u2019indemnit\u00e9 l\u00e9gale.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Cas 2 : salari\u00e9 avec 12 ans d\u2019anciennet\u00e9<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Salaire mensuel brut : 3 000 \u20ac<\/li>\n\n\n\n<li>Anciennet\u00e9 : 12 ans<\/li>\n\n\n\n<li>Calcul :\n<ul class=\"wp-block-list\">\n<li>Pour les 10 premi\u00e8res ann\u00e9es : 3 000 \u00d7 1\/4 \u00d7 10 = 7 500 \u20ac<\/li>\n\n\n\n<li>Pour les 2 ann\u00e9es suivantes : 3 000 \u00d7 1\/3 \u00d7 2 = 2 000 \u20ac<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Total : 7 500 + 2 000 = 9 500 \u20ac<\/li>\n<\/ul>\n\n\n\n<p>\ud83d\udca1 Astuce : certaines conventions collectives pr\u00e9voient des <strong>montants sup\u00e9rieurs<\/strong> au minimum l\u00e9gal.
